Access to and use of the website "www.barnes-montblanc.com" (hereinafter referred to as the "Site"), published by BARNES MONT BLANC (hereinafter "BARNES"), are subject to compliance with these terms and conditions of use (hereinafter the "Terms and Conditions").
By choosing to browse the Site, users acknowledge having read these Terms and Conditions and expressly and unreservedly accept their terms.
Users are informed that their acceptance of these Terms and Conditions does not require a handwritten or electronic signature. The applicable Terms and Conditions are those available online at the time of Site usage.
ARTICLE 2. REAL ESTATE LISTING SERVICE
By browsing the Site, users have access to a service for searching and viewing offers for the sale and rental of real estate properties.
The listings referenced on the Site are posted by agencies, licensees, affiliates, and service providers of the BARNES network and are for informational purposes only.
BARNES undertakes to make its best efforts to ensure that the description of the listings is accurate and regularly updated.
The description of properties for sale or rent, as well as their prices, is the responsibility of the real estate agents holding the mandates. Consequently, BARNES cannot be held responsible for any errors regarding the accuracy, reliability, and availability of the properties mentioned in the listings.
BARNES reserves the right to correct, at any time and without prior notice, the content of real estate listings published on its Site.
ARTICLE 3. LIABILITY
BARNES shall not be held liable in any event for failure, breakdown, or operational interruption preventing users from accessing all or part of the Site.
Users are responsible for their equipment, data, and use of the Site.
BARNES shall not be held responsible for any viruses that may affect its Site or the server making it available.
ARTICLE 4. INTELLECTUAL PROPERTY
BARNES, its licensees, affiliates, and service providers are the sole holders of intellectual property rights over the elements inherent to the Site (trademarks, photographs, graphics, texts, icons, sounds, logos, videos, etc.) and the software applications that operate it.
Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements without the prior written consent of BARNES is strictly prohibited. Any unlawful act shall engage the liability of its author.

The Site contains hyperlinks redirecting to websites operated by BARNES network agencies and service providers, as well as third-party websites. BARNES exercises no control over these sites and disclaims any responsibility regarding access, content, use, and any damages that may result from them.
ARTICLE 6. ALERTS AND NEWSLETTERS
BARNES offers to keep users informed of news related to the BARNES network and offers they may benefit from.
To this end, while browsing the Site, users have the option to voluntarily subscribe to the following newsletters:
- Market updates in France
- Market updates abroad
- Buildings
- Commercial real estate
- Hotels
- New developments
- Conferences and exhibitions
- Art consulting
- SoBarnes - Luxury World
Users can select from these different categories the newsletters they wish to subscribe to.
Users can also create customized alerts for property searches for sale and rental by simply providing their email address.
Users may unsubscribe from newsletters and alerts at any time by clicking the unsubscribe hyperlink located at the bottom of each electronic communication received.
ARTICLE 7. PERSONAL DATA
BARNES implements a Personal Data Protection Policy ("Personal Data"), made available to users on the Site (consult the Personal Data Protection Policy).
Users' Personal Data may be collected when a user wishes to access the following services:
- Creating alerts, subscribing to mailing lists, newsletters;
- Contacting us following a request for a property visit or valuation;
- Contacting us to submit a job application.
The collected information is intended to be processed by authorized personnel for this purpose and will be retained for the time necessary to process users' requests.
Users have the right to access, rectify, delete, oppose, complain, limit, and transfer their Personal Data.

ARTICLE 8. MODIFICATION
BARNES reserves the right to modify these Terms and Conditions at any time.
Users are therefore invited to regularly consult the Terms and Conditions to be informed of any possible changes.
ARTICLE 9. NULLITY – INDEPENDENCE OF CLAUSES
In the event that any provision of these Terms and Conditions is declared null or unenforceable in whole or in part, all other provisions of the Terms and Conditions shall remain valid.
ARTICLE 10. JURISDICTION – APPLICABLE LAW
These Terms and Conditions are governed exclusively by French law, including private international law rules.
In the event of discrepancies between the different linguistic versions of the Terms and Conditions, only the French version shall prevail.
In case of difficulties in the execution and/or interpretation of these Terms and Conditions and prior to any legal action, the User undertakes to contact BARNES to amicably resolve the dispute.
Failing an amicable agreement, jurisdiction is granted to the courts under the jurisdiction of the Paris Court of Appeal, notwithstanding multiple defendants and/or third-party claims, to settle any disputes relating to the use of the Site and/or the validity, execution, and interpretation of these Terms and Conditions.
